Frequently Encountered Personal Injury Cases.

There are many types of personal injuries that a local lawyer may have to address in a personal injury case. Here are some of the common types of personal injuries encountered most frequently.

Slip-And-Fall Incidents

These occur almost daily and can happen just about anywhere to anyone. Research has shown that nearly one-quarter of hospital emergency room visits in the USA are attributed to falls.

Common reasons for these incidents include wet floors, obstructions, hidden dangers, or a general lack of floor care leading to uneven surfaces. Falls can cause significant injuries, some of which may have lifelong consequences, especially if the injury is severe.

All property owners across the country have a legal obligation to ensure that their premises are reasonably safe. If negligence in this regard can be proven, property owners might be held accountable for slip and fall incidents resulting in injury. In the case of a slip and fall incident, it's crucial to capture picture evidence immediately before seeking medical attention.

Car Accidents

Outside of slip-and-fall accidents, car accidents are the most common cause of injury in the US. Even if you are a careful driver, there is no guarantee that another driver will not impact your vehicle and cause a collision, which might result in significant personal injury.

If a car accident occurs, it is important to collect all the evidence involved as soon as possible. Thankfully, the police are often on the scene of accidents shortly after they occur, which can significantly help in building a winnable case.

Hazardous Conditions

Slip-and-fall incidents typically relate to flooring. However, other hazardous conditions could exist on other people's properties, leading to injury. These could include improperly covered holes, sharp objects, broken glass, or items at heights that could fall.

There are various ways hazardous conditions could cause injury and lead to a personal injury claim against the property owner. It is crucial to document all evidence of the incident at the scene before seeking medical attention.

Dog Bites

A common injury in Florida and elsewhere across the country is dog bites. Dog bites are judged rather strictly, and the liability lies squarely with the owner. Owners are required to keep their dogs either restrained in enclosed spaces or on leashes at all times. Any dog that bites you becomes the owner’s legal responsibility, and you have every right to sue in the case of a dog bite.

Defective Products

Defective products sold to you are liable for legal action if they cause harm when used correctly. There are strict liability laws in place to protect consumers from products that harm the user, even if the manufacturer was not directly involved in the incident.

School Negligence

In Florida, public schools owe a general duty of supervision to their students. If a child suffers an injury at school due to negligent conduct by school employees, there can be many challenges dealing with the aftermath such as medical care, medical bills, pain, suffering and stress associated with personal injuries. While Florida Sovereign Immunity laws limit financial recovery and prescribe how a government entity can be sued, there is no immunity per se for negligent acts of school employees. A lawsuit can be filed against a school or school district for negligent failure to act in carrying out this duty.
